DUI is Driving Under The Influence

If you are not driving, no problem. Although you could get busted for being drunk and disorderly in public.

DUI = Driving Under The Influence

If your not the driver, you cant be charged for Driving Under The Influence, however you can be charged for public intoxication, disorderly conduct.

No you can’t be charged with DUI as a passenger, you CAN however be arrested and charged with Public Intoxication.

Actually a jerk D.A. can argue the point of “driving”:

there are plenty of cases debating this word and concept.

They can argue you were in a moving car [sorry can't cite case]; you were aiding a driver that was also intoxicated and unable to drive in his place [sorry no cite]; even a parked car can get you a DUI [sorry can't cite case].

So, there is no absolute NO to the question. For the most part it is a NO but the D.A. can be hard as nails and charge you.

The rest of the answer about peripheral charges are possible too. But get a lawyer and get them dismissed: especially probable cause to even charge you.
