Actually a jerk D.A. can argue the point of “driving”:
there are plenty of cases debating this word and concept.
They can argue you were in a moving car [sorry can't cite case]; you were aiding a driver that was also intoxicated and unable to drive in his place [sorry no cite]; even a parked car can get you a DUI [sorry can't cite case].
So, there is no absolute NO to the question. For the most part it is a NO but the D.A. can be hard as nails and charge you.
The rest of the answer about peripheral charges are possible too. But get a lawyer and get them dismissed: especially probable cause to even charge you.

If you are not driving, no problem. Although you could get busted for being drunk and disorderly in public.
